The meaning of terms used below: You = The Customer, Us = MJG-Photography.
2. PACKAGING & TRANSIT
You are responsible for the packaging and transit of all products you sent to us. We will use the same packaging to return the product by the transit method of your choice. All transit costs are your responsibility.
Please ensure that the product is fully insured whilst in transit and at our office. We connot be held responsible for any products that go missing in transit or are damaged.
The photographer at all times throughout the world retains the entire copyright in the photographs. By providing us with a product to photograph you give us the right to use the images for self-promotional purposes.
5. RIGHT TO REFUSE
We reserve the right to refuse to photograph any product we deem to be unsuitable, inappropriate or offensive.
6. CLIENT CONFIDENTIALITY
We will keep confidential and will not disclose to any third parties or make use of material or information communicated to us in confidence for the purposes of the photography, save as may be necessary to enable us to carry out our obligations in relation to the commission.
Payment will be expected for the commissioned work upon presentation of invoice.
The licence to use the commissioned work comes into effect from the date of payment of the relevant invoice. No use may be made of the commissioned work before payment in full is received. If permission is given prior to payment of invoice this will be automatically revoked if full payment is not made by the due date.
An order is considered firm as from the date of confirmation and accordingly we will, at our discretion, charge a cancellation fee.
10. RIGHT TO A CREDIT
If the box on the estimate or licence marked "Right to a Credit" has been ticked, the Photographer's name will be printed on or in reasonable proximity to all published reproductions of the photograph(s). By ticking the box the Photographer also asserts his/her statutory right to be identified in the circumstances set out in sections 77-79 of the Copyright, Designs and Patents Act 1988 or any amendment or re-enactment thereof.
11. SUPPLY TO THIRD PARTIES
The licence to use only applies to the customer named on the invoice unless otherwise stated.
12. APPLICABLE LAW
This agreement shall be governed by the laws of England & Wales.
These Terms & Conditions shall not be varied except by agreement in writing.
